Speed of Me, LLC ("Speed of Me", "we", "us", or "our") is committed to protecting the personal data of individuals who use our website, in accordance with the applicable law of the United States and, for individuals in the EU, the EU's General Data Protection Regulation (GDPR) as regards the use of their personal data while they are located in the EU. We take reasonable and appropriate measures intended to protect personal data and to reduce the risk of unauthorized disclosure to third parties, but no method of transmission or storage is completely secure and we cannot guarantee absolute security. We are not responsible for other websites linked from our site, or for the services of third parties accessible through our website.

Information about visitors that becomes known to us as a result of their use of our Website is processed according to the intended purpose, e.g. to provide the requested information or services.

To be able to provide services and decide about the necessity of improving the layout or content of our Website, information about its visitors that we have collected in the access files, e.g. IP address, Internet provider, access timing, and the viewed sections is also processed. If the Internet speed gauge is used, we process the measured result.

How We Process Personal Data

For personal data of visitors to our website, Speed of Me, LLC is the controller. Where we process speed test data on behalf of an API customer for that customer's own end users, we act as a processor on that customer's instructions, and the API customer is the controller.

Where the GDPR applies, we rely on the following legal bases: performance of a contract or to provide a service you request (for example, running a speed test you start); our legitimate interests (for example, securing, operating, analyzing, and improving the Service, and producing aggregated statistics); and your consent (for example, for non-essential cookies and personalized advertising, which you can withdraw at any time without affecting processing carried out before withdrawal).

You may exercise the data-protection rights available to you under applicable law, including the right to access your data, object to or restrict processing, withdraw consent, request rectification, deletion, restriction, or transfer of your data, and lodge a complaint with your supervisory authority. To make a request, please contact us.

Because we store speed test records by IP address rather than by name or account, we can only locate your data if you provide the IP address together with the date and time the test was run. Please include this information when you contact us; otherwise we will not be able to find or act on your records.

Speed of Me, LLC takes reasonable steps to comply with the privacy laws that apply to us. Definitions

Account and API Information

If you register for the SpeedOf.Me API or API Portal, we collect the information you provide to create and manage your account, such as your name, email address, password (stored only in hashed form), and any website domain(s) you authorize for API use. We use this information to operate your account, provide the API, communicate with you about your account or subscription, and enforce our Terms of Service.

Payment Information

Paid API subscriptions are processed by our third-party payment provider. Your card details are entered with and handled by that provider; we do not collect or store full payment card numbers on our servers. We receive only the limited billing information (such as your plan, billing status, and the contact details associated with the subscription) needed to manage your account.

Speed Test Results

When a speed test runs, we process and may store the test result together with technical details such as your IP address, the approximate geographic location derived from that IP address, your network or ISP, and your device or browser type. We use this information to deliver and display your result, operate and improve the Service, and produce aggregated, de-identified statistics. Because these records are indexed by IP address, please include your IP address and the date and time of the test when you contact us about your data (see "How We Process Personal Data" above).

Categories of Personal Information We Collect

This section summarizes, for U.S. state privacy laws such as the CCPA/CPRA, the categories of personal information we collect, where it comes from, why we use it, and who we share it with. We collect this information directly from you, from your device and browser automatically, and from service providers such as analytics and advertising partners.

  • Identifiers (IP address; and for API account holders, name and email): to deliver and display speed test results, operate and secure the Service, manage accounts, and provide support. Shared with hosting/CDN, analytics, advertising, and (for accounts) payment providers.

  • Internet and network activity (network/ISP, browser and device type, test results, pages viewed): to run and improve the test, for analytics, and to produce aggregated, de-identified statistics. Shared with hosting/CDN and analytics providers.

  • Approximate geolocation (city or region derived from your IP address, not precise location): to select test servers, display results, and for analytics. Shared with hosting/CDN and analytics providers.

  • Commercial information (subscription plan and billing status, for API customers): to manage subscriptions and billing. Shared with our payment provider.

We do not collect sensitive personal information, and we do not use or disclose personal information for purposes other than those described in this Privacy Policy. For how long we keep each type of information, see "Data Retention" below; for your choices and rights, see "Your Privacy Rights."

How We Use Your Information

We use the information we receive from you as follows:

  • Customizing Our Website

    We may use the Personally Identifiable information you provide to us along with any computer information we receive to customize our Website.

  • Sharing Information with Affiliates and Other Third Parties

    We do not sell, rent, or otherwise provide your Personally Identifiable Information to third parties for marketing purposes. We may provide your Personally Identifiable Information to affiliates that provide services to us with regards to our Website (e.g. payment processors, Website hosting companies, etc.); such affiliates will only receive information necessary to provide the respective services and will be bound by confidentiality agreements limiting the use of such information.

  • Data Aggregation

    We retain the right to collect and use Non Personal Information from your use of our Website, and to aggregate and de-identify such data for internal analytics that improve our Website and Service, as well as to share, license, or sell that aggregated, de-identified data to others. We maintain such data in aggregated and de-identified form, take reasonable measures to ensure it cannot be associated with or reasonably linked to you, publicly commit not to attempt to re-identify it (except as permitted by law to test those measures), and contractually require any recipient to keep it de-identified and not attempt to re-identify it. Aggregate and de-identified information is not personally identifiable, never includes your Personally Identifiable Information, and is not "personal information" under applicable U.S. privacy laws. We do not sell your Personally Identifiable Information.

  • Legally Required Releases of Information

    We may be legally required to disclose your Personally Identifiable Information, if such disclosure is (a) required by subpoena, law, or other legal process; (b) necessary to assist law enforcement officials or government enforcement agencies; (c) necessary to investigate violations of or otherwise enforce our Legal Terms; (d) necessary to protect us from legal action or claims from third parties including you and/or other Members; and/or (e) necessary to protect the legal rights, personal/real property, or personal safety of Speed of Me, LLC, our Users, employees, and affiliates.

Advertising and Your Consent Choices

We use Google AdSense to display ads and Google Analytics to understand how the Website is used. Where required, we ask for your consent through a notice on the site and apply Google Consent Mode. In the EEA, the UK, and Switzerland, advertising and analytics storage stay off until you consent. In US states with applicable privacy laws, we limit ad personalization and the sharing of advertising identifiers by default. We also honor the Global Privacy Control (GPC) browser signal where it applies. Your Privacy Rights

Depending on where you live, you may have rights over your personal information, including the right to access, correct, delete, or receive a copy of it, to object to or restrict certain processing, and to withdraw consent. We do not sell your Personally Identifiable Information. The only data we license or sell to others is aggregated, de-identified information that does not identify you (see "Data Aggregation" above). We honor the Global Privacy Control signal as a request to opt out of any sharing for cross-context behavioral advertising. To exercise any of these rights, contact us; we will not discriminate against you for making a request. As noted above, please include your IP address and the date and time of your visit so we can locate your records.

Data Retention

We keep personal information only for as long as needed for the purposes described in this Privacy Policy, including to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. We retain account information for as long as your account is active, and we retain speed test records and aggregated statistics for as long as they remain useful for operating and improving the Service. You may ask us to delete your information as described in "Your Privacy Rights."

Service Providers

We share personal information with trusted third parties only as needed to operate the Service, such as cloud hosting and content delivery, analytics, advertising, payment processing, and customer support. These providers may process information on our behalf and are expected to safeguard it and use it only for the services they provide to us.

International Data Transfers

Speed of Me, LLC is based in the United States, and the information we process is handled in the United States and other countries where we or our service providers operate. If you access the Service from outside the United States, you understand that your information may be transferred to and processed in the United States, where data protection laws may differ from those in your country. Where we transfer personal data out of the EEA, the UK, or Switzerland, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses (and the UK International Data Transfer Addendum and the Swiss addendum where applicable).

Children's Privacy

Running a speed test on our website does not require an account; accounts for the SpeedOf.Me API are available only to users 18 or older (see our Terms of Service). The Service is not directed to children, and we do not knowingly collect personal information from children under 13 (or the minimum age required in your country). We do not knowingly sell or share the personal information of consumers under 16 years of age. If you believe a child has provided us with personal information, contact us and we will take appropriate steps to delete it.

Email Communications

We send account holders service and transactional emails (for example, about account activation, billing, or account changes); these are necessary to operate your account and are not promotional. If we ever send promotional email, it will include an unsubscribe link and we will honor opt-out requests promptly. You can update your email preferences at any time by contacting us.

Privacy Policy Updates

We reserve the right to modify this Privacy Policy at any time. You should review this Privacy Policy frequently. If we make material changes to this policy, we will notify you, for example by posting a notice on our Website or by email; the method of notice is at our sole discretion. We will also update the "Last updated" date below. Any changes we make to our Privacy Policy are effective as of that date and replace any prior Privacy Policies.
